A billionaire US hedge fund manager has been given the green light by the high court in London to force three websites – including Wikipedia – to disclose the identities of online commenters alleged to have defamed him.

Louis Bacon, the founder and chief executive officer of Moore Capital Management, was given permission on Monday to use a UK court order to obtain the information from the US publishers behind Wikipedia, the Denver Post newspaper, and the popular blogging platform WordPress.

Bacon wants to launch defamation proceedings against a number of online commenters – all of whom use sobriquets like "gotbacon" and "TCasey82" – alleged to have posted libellous material about him on these websites.

In the high court on Monday, Mr Justice Tugendhat granted Bacon's application to serve a court order – known as a Norwich Pharmacal Order (NPO) – by email against these websites. However, legal experts have told the Guardian that the US-based companies could legally ignore or refuse to comply with the orders.


Proof that lawyers are willing to take a billionaraire's money to prosecute a lawsuit which is going to get him nowhere, and not even succeed in mildly bothering his targets. I AM SHOCKED. blink.gif Those lawyers are verging toward becoming unethical in their dealings. ohmy.gif

Not only will Wikipedia ignore this 3 ways from Sunday, but it couldn't tell the plaintiff who the its editors were in RL, even if it decided not to ignore it.

He's probably spent enough on this stupid lawsuit to allow me to retire, and I could have told him he was flushing his money down the toilet, and not even getting harassment value out of it, in about 2 minutes.

I am concerned that the world is becoming unjust. ermm.gif Also, that billionaires are not as smart as we all thought they are. huh.gif The sun is not shining today and it's overcast. unhappy.gif Who do I complain to, about this stuff? mellow.gif

Oh, Milton. If he's a billionaire, then him spending maybe $30,000 on an attorney to pursue this could be the equivalent of you or me spending $30. At the worst, it's getting his name out there in the media, and he's defending his reputation. At best, he gets an IP address from at least one of the sites, and he can then determine which customer of the ISP was using the service to defame him at that particular time, and then it's a piece of cake to make life miserable for that miscreant.

Take a look at the contributions of TCasey82 (T-C-L-K-R-D) . They mainly added external links or referenced material (albeit not always the best references for a BLP). They actually removed some unsourced material involving clothing designer and Bacon neighbour Peter Nygaard, with whom Bacon is feuding. I suspect Bacon knows who his online nemesis is and just needs to prove it before setting the lawyers on them.

Victims of online libel have identified the contributors responsible in the past, via their ISP or IP. Notably the Seigenthaler chap.

I don't know if there's anything oversighted (using the old extension that was phased out over a year ago), but there isn't anything revision deleted (greyed out and stricken) and there is nothing in the deleted contributions.
